These Terms of Use govern your access to and use of Clearness, including clearness.pro and the Clearness service. By accessing or using Clearness, you agree to these Terms. If you do not agree with them, please do not use the service. Clearness is designed to help people reflect on what is occupying their thoughts, recognize possible patterns, and consider useful next steps. These Terms are intended to establish clear expectations while allowing Clearness to provide that service responsibly.
Clearness provides an artificial-intelligence-assisted reflection and insight service. You may submit written information about a question, concern, situation, thought, decision, or other subject, and Clearness may generate observations, perspectives, questions, or suggested next steps based on that information. Clearness is intended as a tool for reflection and general informational purposes. The service may change as it is developed and improved.
Clearness does not provide medical, mental-health, legal, financial, investment, accounting, or other licensed professional advice. Nothing generated by Clearness creates a professional-client relationship or should be treated as a diagnosis, treatment plan, legal opinion, financial recommendation, or substitute for qualified professional judgment. If a situation involves health, safety, legal rights, finances, or another matter requiring professional expertise, you should seek assistance from an appropriately qualified professional. If you believe you or another person may be in immediate danger, contact appropriate emergency services.
You are responsible for the information you choose to submit and for decisions you make after using the service. You agree to use Clearness lawfully and not to misuse, interfere with, disrupt, reverse engineer, circumvent usage restrictions, probe for vulnerabilities, or attempt unauthorized access to the service or its supporting systems. You should not submit information that you do not have the right to provide or information that you do not want processed as described in the Clearness Privacy Policy.
Clearness uses artificial intelligence to generate portions of its responses. Artificial intelligence can misunderstand context and can produce information that is incomplete, inaccurate, outdated, inconsistent, or otherwise unsuitable for a particular situation. You are responsible for evaluating Clearness responses and deciding whether and how to act on them. Important decisions should not be based solely on an AI-generated response when independent verification or qualified professional judgment would reasonably be appropriate.
The Clearness name, branding, website design, software, systems, original content, and other materials provided as part of the service are owned by Clearness or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, you may use Clearness and the insights generated for you for your own lawful personal or business purposes. You retain whatever rights you may have in the information you submit. Nothing in these Terms transfers ownership of the Clearness service, technology, branding, or underlying systems to you.
Clearness relies on third-party providers for portions of its operation, which may include hosting and server infrastructure, artificial-intelligence processing, email delivery, domain and internet services, and related technology. Clearness does not control every aspect of these third-party services. Their availability, performance, security practices, and handling of information may also be governed by their own terms and policies.
We aim to make Clearness reliable and useful, but we do not guarantee that the service will always be available, uninterrupted, error-free, or unchanged. Features may be added, modified, limited, suspended, or discontinued as the service evolves. Clearness may establish or modify reasonable usage limits and other operational controls intended to protect availability, security, fairness, or sustainability of the service.
To the extent permitted by applicable law, Clearness is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. We do not warrant that Clearness will produce a particular result, identify every relevant consideration, be appropriate for every person or situation, or that AI-generated information will always be accurate or complete. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, Clearness and those involved in providing the service will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, opportunities, or other intangible losses arising from or related to your use of, or inability to use, Clearness. To the extent liability cannot lawfully be excluded, any limitation will apply only to the fullest extent permitted by applicable law. Nothing in these Terms limits liability that applicable law does not permit to be limited.
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, costs, and expenses arising from your unlawful misuse of Clearness, your material violation of these Terms, or your infringement of another person’s rights. This provision does not require you to indemnify Clearness for conduct for which indemnification cannot lawfully be required.
You may stop using Clearness at any time. Clearness may restrict or terminate access to the service when reasonably necessary to address misuse, security threats, violations of these Terms, legal requirements, or risks to Clearness, its providers, or other users. Provisions that by their nature should continue after termination—including provisions concerning intellectual property, disclaimers, limitations of liability, and applicable law—will survive termination to the extent legally enforceable.
These Terms are governed by the laws applicable in the State of Maryland, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise. Nothing in these Terms prevents a consumer from receiving protections or exercising rights that cannot lawfully be waived under applicable law.
Clearness may update these Terms as the service develops or as legal, operational, or security requirements change. When material changes are made, the effective date displayed on this page will be updated. Your continued use of Clearness after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
