These Terms are intended to establish clear expectations while allowing Clearness to provide that service responsibly.

Clearness is intended as a tool for reflection and general informational purposes. The service may change as it is developed and improved.

Clearness uses artificial intelligence to generate portions of its responses. Artificial intelligence can misunderstand context and can produce information that is incomplete, inaccurate, outdated, inconsistent, or otherwise unsuitable for a particular situation. You are responsible for evaluating Clearness responses and deciding whether and how to act on them. Important decisions should not be based solely on an AI-generated response when independent verification or qualified professional judgment would reasonably be appropriate.

The Clearness name, branding, website design, software, systems, original content, and other materials provided as part of the service are owned by Clearness or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, you may use Clearness and the insights generated for you for your own lawful personal or business purposes. You retain whatever rights you may have in the information you submit. Nothing in these Terms transfers ownership of the Clearness service, technology, branding, or underlying systems to you.

Clearness does not control every aspect of these third-party services. To the maximum extent permitted by applicable law, Clearness and those involved in providing the service will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, opportunities, or other intangible losses arising from or related to your use of, or inability to use, Clearness. To the extent liability cannot lawfully be excluded, any limitation will apply only to the fullest extent permitted by applicable law. Nothing in these Terms limits liability that applicable law does not permit to be limited.

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, costs, and expenses arising from your unlawful misuse of Clearness, your material violation of these Terms, or your infringement of another person’s rights. This provision does not require you to indemnify Clearness for conduct for which indemnification cannot lawfully be required.

You may stop using Clearness at any time. Clearness may restrict or terminate access to the service when reasonably necessary to address misuse, security threats, violations of these Terms, legal requirements, or risks to Clearness, its providers, or other users. Provisions that by their nature should continue after termination—including provisions concerning intellectual property, disclaimers, limitations of liability, and applicable law—will survive termination to the extent legally enforceable.

These Terms are governed by the laws applicable in the State of Maryland, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise. Nothing in these Terms prevents a consumer from receiving protections or exercising rights that cannot lawfully be waived under applicable law.
